By accessing or using the Fluid Playback website and services, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service.

2. Services Provided

Fluid Playback provides media server rentals, engineering services, and playback systems (including Dataton WATCHOUT, Disguise, and Resolume). All hardware and services are subject to separate rental agreements and availability.

3. Limitation of Liability

Service is Provided "AS IS"

The materials and services on Fluid Playback's website are provided on an "AS IS" and "AS AVAILABLE" basis. Fluid Playback Systems LLC makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

In no event shall Fluid Playback Systems LLC or its suppliers be liable for any consequential damages, direct or indirect, including without limitation: lost profits, business interruption, loss of data, missed opportunities, missed purchases, or any inaccuracies in external databases (including but not limited to DOJ roster inaccuracies) arising out of the use or inability to use the materials or services provided.

4. Acceptable Use Policy

You agree not to use the Website or Services to:

  • Violate any local, state, national, or international law or regulation.
  • Transmit any material that is abusive, harassing, tortious, defamatory, vulgar, pornographic, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Website.
  • Take any action that imposes, or may impose at our sole discretion, an unreasonable or disproportionately large load on our infrastructure.

5. Revisions and Errata

The materials appearing on Fluid Playback's website could include technical, typographical, or photographic errors. Fluid Playback does not warrant that any of the materials on its website are accurate, complete, or current. We may make changes to the materials contained on its website at any time without notice.

6. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of California, and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
